{"id":17,"date":"2026-05-11T07:29:15","date_gmt":"2026-05-11T07:29:15","guid":{"rendered":"https:\/\/mimovoyages.geekworkers.dev\/?page_id=17"},"modified":"2026-06-18T08:02:44","modified_gmt":"2026-06-18T08:02:44","slug":"cgv","status":"publish","type":"page","link":"https:\/\/mimo-voyages.ch\/en\/cgv\/","title":{"rendered":"Terms and Conditions"},"content":{"rendered":"<p class=\"wp-block-paragraph\">These General Terms and Conditions of Sale (<strong>Terms and Conditions<\/strong>) govern the contractual relations between <strong>Dar Cristina <\/strong><strong>Ltd<\/strong>, a limited liability company incorporated under Swiss law with its registered office in the canton of Fribourg (the\u2019<strong>Organiser<\/strong>), and any person making a booking for tourist services via the Organiser\u2019s website, social media or any other communication channel (the <strong>Client<\/strong>) from the Organiser.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1. Purpose<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Organiser offers tourist services for sale comprising exclusively:<br>\u2013 bookings for hotel rooms in Tunisia; ;<br>\u2013 transfer services between the airport and the hotel, and between the hotel and the airport (in connection with the above-mentioned bookings);<br>\u2013 bookings for activities (cultural, artistic, etc.) in Tunisia (booked independently of and separately from hotel rooms and transfer services).<br><br>Services can be sold separately or as part of detailed packages.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">3. Acceptance of the terms and conditions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Any booking made with the Organiser implies full and unconditional acceptance of these Terms and Conditions. The Customer acknowledges that they have read these terms and conditions before confirming their order.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4. Bookings<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Bookings can be made via the official website, social media, by email or by telephone.<br><br>The booking is considered final following written confirmation (by email or any other means providing proof of transmission) from the Organiser and receipt of the agreed payment into the Organiser\u2019s specified account.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">5. Prices and payment<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Prices are quoted in Swiss francs (CHF) or euros (EUR), depending on the published offer. Prices include only the services specified in the offer.<br><br>Unless otherwise stated, local taxes, insurance, personal expenses and services not mentioned in the offer are to be borne exclusively by the Client. These costs will be charged by the service providers with whom the Client enters into a contract for accommodation, transport or activities.<br><br>The Customer may make payment by bank transfer, credit card or any other method accepted by the Organiser. The Organiser reserves the right to require full or partial payment before confirming the booking.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">6. Amendments and cancellations by the Customer<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Any request to amend or cancel a hotel booking, a transfer between the airport and the hotel and vice versa, or any activities, may only be made by the Customer and must be submitted in writing (by email only) to the Organiser. As the Organiser\u2019s other communication channels are not necessarily actively monitored, requests for changes or cancellations sent via channels other than email will not be deemed to have been received by the Organiser.<br><br><strong>Charges may apply depending on the date of amendment or cancellation and in accordance with the terms and conditions of our partner hotels<\/strong><strong> (see section 6.1), transport providers (see section 6.2) and <\/strong><strong>d<\/strong><strong>activity providers (see section 6.3)<\/strong><strong>.<\/strong><strong><br><\/strong><br>In the event that the Customer or the persons for whom the Customer has made a booking fail to attend (\u00abno-show\u00bb), no refund of any payment made by the Customer to the Organiser may be claimed. Furthermore, any amount owed by the Customer to the Organiser remains fully valid.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6.1 Cancellation of hotel-only bookings (HOTEL ACCOMMODATION WITHOUT FLIGHTS)<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The following fixed charges and charges as a percentage of the tour price apply:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">31\u20134 days before the day of arrival: booking fee: 50.- per person only<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3\u20132 days before the day of arrival: booking fee of 50.- per person + 30 % of the total booking amount<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The day before the day of arrival \/ the day of arrival \/ no-show: 100 % of the total booking amount (see section 6)<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6.2 Cancellation of transfer services between the airport and the hotel, and between the hotel and the airport<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The following charges apply:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">31\u20134 days before the day of arrival: no charge<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3 days or less before the day of arrival: 100 % of the total amount of the transfer service booking<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6.3 Cancellation of local activities depending on the offer<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The following charges apply:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">31\u20133 days before the day of arrival: no charge<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3 days or less before the day of arrival: 100 % of the total booking amount for the activity or activities<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">7. Changes or cancellations by the Organiser<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Organiser reserves the right to amend or cancel an event in the event of force majeure, such as a security issue, a natural disaster, a strike, administrative measures (this list is not exhaustive) or any other event beyond its control.<br><br>In such cases, the Organiser will, where possible, offer an equivalent alternative or a refund for the services not provided.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">8. Liability<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Organiser acts as an intermediary between the Customer and partner hotels, transport providers and local activity providers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>The Organiser shall not be held liable for any damage, loss, delay, accident, theft, flight cancellation, refusal of entry into Tunisia or any other event for which a third party or the local authorities are responsible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>The Customer is responsible for ensuring that their travel documents (passport, visa, health authorisations, etc.) are valid, as well as those of any accompanying persons.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">9. Insurance, high-risk activities, medical information<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer is responsible for ensuring that they, and any accompanying persons, have adequate insurance cover for the duration of their trip, in particular covering accidents, illness, repatriation, third-party liability, cancellation, and loss or theft of luggage. In this regard, the Organiser strongly recommends that the<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The customer should take out travel insurance covering the risks associated with the booked holiday for themselves and any accompanying persons.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is the Customer\u2019s responsibility to check, before departure, that the insurance cover they and their travelling companions have provides sufficient cover for the holiday, the activities booked and the destination country.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The Organiser cannot be held liable for any damage <\/strong><strong>related<\/strong><strong> in the event of an accident, illness requiring repatriation, or civil liability, <\/strong><strong>cancellation and loss or theft of luggage<\/strong><strong> as well as <\/strong><strong>financial consequences <\/strong><strong>which results in<\/strong><strong>nt<\/strong><strong> the lack of adequate insurance cover or the insurer\u2019s refusal to cover the <\/strong><strong>C<\/strong><strong>link<\/strong><strong> of these financial consequences<\/strong><strong>.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All medical, hospitalisation, repatriation and rescue costs, or any other costs arising from an accident, illness or similar event occurring during the stay, shall be borne by the Customer or their insurer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer is required to inform the Organiser, during the booking process, of any medical condition that may affect their participation or that of any persons accompanying them on the holiday or in certain activities. Failing this, the Organiser cannot be held liable for any consequences arising from the Customer\u2019s or their accompanying persons\u2019 inability to take part in the booked services.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">10. Personal data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Organiser processes the personal data of the Customer and any accompanying persons (including name, contact details, date of birth, travel details and, where applicable, information required for the booking, such as passport or health details) in accordance with the applicable Swiss data protection legislation, to the extent that this is necessary for the organisation, booking and provision of the services ordered.<br><br>In order to make bookings and provide the services requested, the Organiser will pass on the personal data required for this purpose to the relevant service providers, in particular hotels, airport-to-hotel transport or activity providers, local agencies, and, where necessary, insurers and the authorities in Tunisia. The Customer acknowledges and accepts that such disclosure may also take place in countries outside Switzerland, including countries whose legislation does not guarantee a level of data protection equivalent to that provided by Swiss law. Insofar as the country concerned guarantees adequate protection or appropriate safeguards within the meaning of Article 16(2) of the Data Protection Act (LPD) exist, the transfer abroad is based on this foundation. Furthermore, the transfer is directly linked to the services ordered by the Customer and is carried out in their interest. Where data is transferred to a country that does not guarantee an adequate level of protection and in the absence of safeguards<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">where applicable, the Customer expressly consents to this disclosure by making the booking.<br><br>The Organiser reserves the right to use cookies and an internet analytics service. By using our website, the Customer consents to the processing of data collected for the purpose of analysing website usage. The Customer may disable cookies at any time via their web browser settings.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>11<\/strong><strong>.<\/strong><strong> <\/strong><strong>Claims and obligations of the <\/strong><strong>C<\/strong><strong>link<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of any complaints during the holiday, the Customer must inform the Organiser immediately.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>In the event of any difficulties, dissatisfaction or a complaint (a <strong>Defect<\/strong>) occurring during the stay or whilst the booked services are being provided, the Customer is required to inform the relevant service provider (hotel, transfer service, activity) as soon as possible so that an appropriate solution can be found without delay (in particular by rectifying the defect or by changing rooms). The notification is not subject to any specific form; in particular, it may be given verbally or in writing (e.g. by email).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>Any defects which, despite the care that may reasonably be expected, only become apparent after the stay must be reported to the Organiser within a reasonable time of their discovery.<br><br>The Customer must allow the service provider and the Organiser to resolve the problem identified within a reasonable period of time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>If the Client fails, through their own fault, to report an apparent Defect in good time, their rights arising from the Defect shall lapse only to the extent that the Organiser has thereby been deprived of the opportunity to remedy it. Furthermore, the Client\u2019s statutory rights arising from the Defects shall remain in force.<br><br>The above provisions do not apply to claims arising from damage caused intentionally or through gross negligence on the part of the Organiser; in this regard, the Organiser shall be liable in accordance with the relevant statutory provisions. Mandatory provisions relating to warranty and limitation periods in favour of consumers, in particular the minimum limitation periods, remain reserved in all cases.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">12. Intellectual property<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">All content published on the Organiser\u2019s website and social media channels (text, logos, images, videos, graphic elements) is the property of the Organiser and is protected by intellectual property rights. Any reproduction or use without the Organiser\u2019s prior written authorisation is prohibited.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Photographic works, works of fine art (paintings, sculptures, graphic works, audiovisual works, sound recordings and design objects) and literary works by signed artists featured on the Mimo Voyages website are protected by copyright, trade mark law and patent law (the Federal Act on Copyright and Related Rights (Copyright Act, LDA) and Directive 2001\/84\/EC of the European Parliament and of the Council of 27 September 2001 on the resale right for the benefit of the author of an original work of art). It is prohibited to copy, modify, download or otherwise use these elements or parts thereof for personal or commercial purposes without<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">the Organiser\u2019s prior written consent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Any user who has their own home page and wishes to create a link to the Organiser\u2019s home page on their own home page for personal purposes must obtain the Organiser\u2019s prior written consent to do so. The use of any hyperlink to the Organiser\u2019s homepage utilising framing technology or inline linking is not permitted. In all cases, all hyperlinks, even those brought to the Organiser\u2019s attention, must be removed upon the Organiser\u2019s first request, without the Organiser having to make a formal demand to the operator of the link.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">13. Applicable law and jurisdiction<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">These General Terms and Conditions, together with the contract relating to the services ordered by the Customer from the Organiser, shall be governed exclusively by Swiss substantive law, to the exclusion of conflict-of-laws rules (in particular the LDIP) and the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980 (CISG\/Vienna Convention).<br><br>In the event of a dispute, the competent courts shall be those of the Organiser\u2019s or the Client\u2019s place of residence, subject to recourse to the competent federal courts.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">14. Geographical marketing areas<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The offers, rates and services marketed by the Organiser are intended exclusively for customers residing in Switzerland and the European Union.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">15.
